Tragic Montgomery County motorcycle accident kills 1

On behalf of Law Offices of Steven H. Dorne posted in Car Accidents on September 7, 2012.

A three-vehicle motorcycle and car accident left a 34-year-old Kingman motorcyclist dead and sent a second motorcyclist to the hospital, according to reports. The accident happened in Montgomery County close to the State Road 32 and County Road 775 intersection around 1:00 p.m. Wednesday of last week. The second motorcyclist, a 35-year-old Rockville man was airlifted from the accident scene and taken to an Indianapolis hospital after the accident.

The motor vehicle involved in the accident was an SUV and that driver was not injured in the crash. The exact cause of the crash in still under investigation as an accident reconstruction team from the Brownsburg Police Department was called in to assist in the investigation. State Road 32 was closed for roughly three hours as emergency responders tended to the injured motorcyclists and investigators tried to piece together evidence to learn just what happened.

The first motorcyclist was pronounced dead at the scene of the accident by the Montgomery County Coroner. The specific injuries of the other motorcyclist were not disclosed. Apparently toxicology reports are pending in the investigation. The driver of the SUV was a 38-year-old female from Colfax. As is common with car and motorcycle accidents, the driver of the SUV was uninjured while the motorcyclists sustained serious bodily injuries.

Although the exact cause of the accident is not yet known, should the investigation determine that one of the drivers was negligent in causing the crash, that driver could be held accountable for damages suffered by those injured. In cases where a vehicle pulls out in front of a motorcycle the driver who causes the crash could be facing not only criminal charges but also a civil suit. In this particular crash, a personal injury suit may result from the injured motorcyclist as well as a wrongful death claim from the family members of the motorcyclist killed in the accident.

The Brownsburg Police Department assisted the Montgomery County Sheriff’s Office in the accident investigation. The Indiana State Police and the Darlington Fire Department are also involved, although why the second motorcyclist was sent to an Indianapolis hospital and why the Indiana State Police are involved in the investigation is unclear at this time.
