Lawmakers in the special session of the Maryland legislature failed to pass a bill that would have overturned a court ruling involving liability issues surrounding animal attacks by pit bulls. Maryland’s highest court previously ruled that pit bulls are to be considered “inherently dangerous,” and that personal injury or premises liability lawsuits involving dog bites by pit bulls did not require proof that the animal had exhibited prior violent behavior in order to hold the owner of the animal liable for damages. The ruling also allowed landlords to be held

As many Maryland residents have no doubt heard, the National Football League has been hit with numerous personal injury and wrongful death lawsuits involving better than 2,400 now retired NFL players who are accusing the league of failing to protect players from brain injuries. The suits claim the NFL failed to act on evidence from the medical community that shows repeated trauma to the head can cause permanent brain injuries, as well as other long-term medical problems. Now, a legal fight is brewing between the NFL and its insurers over

When someone is a passenger in a vehicle, that passenger is putting his or her safety in the hands of another, assuming that driver will drive safely and without incident. That was not the case after a car crashed into a tree on Connecticut Avenue in Chevy Chase Village, killing a female passenger and injuring the male driver. The car crashed into the tree a little before noon last Wednesday on the southbound lanes of Maryland State Route 185, also called Connecticut Avenue, near Irving Street, according to Montgomery County

A child’s cerebral palsy was blamed on doctors in a medical malpractice lawsuit filed against Johns Hopkins after a 2010 birth resulted in a delayed C-section, which deprived the unborn child of oxygen. Apparently a Baltimore, Maryland, jury agreed and awarded the family an unprecedented $55 million in damages. Initially, the mother attempted to give birth at home with the services of a midwife, however when the child became caught during delivery, she was rushed to the hospital for an emergency C-section. The mother was left waiting for blood tests

A bill that seeks to exempt doctors who offer free medical care from malpractice lawsuits has failed to pass in the final legislative session in another state. In an election year in which medical malpractice reform is a hot topic in the Washington D.C. area and around the country, this particular bill, as do many medical malpractice reform efforts, has fierce support and opposition. Opponents argue that this bill is unfair to low-income consumers because it prevents those who seek free medical care from pursuing a medical malpractice claim against

A criminal investigation has resulted from a Baltimore, Maryland, multi-vehicle crash in what police are stating was the result of an incidence of road rage. The truck accident happened on southbound Route 295 earlier this month when a 25-year-old driver in a white pick-up truck in the second lane of the highway began driving out of his designated lane and came close to colliding with a passenger vehicle in the first lane. The driver in that vehicle blasted his horn to alert the truck driver that he was crossing into
